Terms of use
Last updated: [EFFECTIVE DATE]
These terms apply when you use CMX+ (on the web and as an iPhone app) and CMX Pro (on the web), and cover your subscription, cancelling and refunds. By creating an account or starting a subscription, you agree to them. Our privacy and cookies notice explains how we use your personal data.
Who we are
CMX+ and CMX Pro are CMX AI products, provided by CMX Ventures Ltd ("CMX", "we", "us"), a company registered in England and Wales (company number 17136973), with its registered office at Parkside, Station Road, St Mabyn, Cornwall, PL30 3BN. Email hello@cmxai.co.uk or call [PHONE NUMBER].
Your subscription at a glance
- CMX+: £9.99 a month, with a 7-day free trial for first-time subscribers, or £99.99 a year (no free trial). On the web and on iPhone.
- CMX Pro: £49.99 a month or £499.99 a year. On the web only.
- Prices include VAT where applicable.
- Automatic renewal: your subscription renews automatically at the end of each month or year, and the price of your plan is charged to your payment method each time, until you cancel. There is no minimum term beyond the period you have already paid for. On the web, Stripe emails you a receipt for each payment and a reminder before an annual renewal.
- Cancel at any time: on the web, in Account, choose Cancel subscription. On iPhone, cancel through Apple.
- 14 days to change your mind: on the web, within 14 days of your first paid charge, choose Withdraw from contract here in Account for a full refund of that payment (during a free trial, it ends the trial with no charge). Refunds for iPhone purchases are handled by Apple.
Your account
- You must be 18 or over. We will close an account if we learn that its user is under 18.
- Keep your sign-in details secure, and tell us straight away if you think someone else has used your account.
- Your account is for you alone. The same account works on the web and on iPhone.
What CMX+ and CMX Pro include
CMX+ gives you bite-sized AI lessons: 4 pathways and 20 lessons made of swipeable cards, with a daily streak, on the web and as an iPhone app.
CMX Pro, on the web, includes everything in CMX+, plus in-depth online courses, an AI tutor, an AI prompt sandbox, personalised examples and a verifiable course certificate.
At present, the AI tutor and prompt sandbox run in a demo mode that gives sample answers rather than live AI responses. If we switch them to live answers, we will update these terms and our AI transparency statement.
Payment
- On the web, payment is taken by Stripe. We never see your card number.
- On iPhone, you buy through Apple In-App Purchase. Apple takes payment and handles billing under its own terms, and we never see your payment details. You pay the price shown in the App Store for your country, which may differ from the UK prices above.
- If a renewal payment cannot be taken, your access to paid features may stop until payment is made.
Free trial
The CMX+ monthly plan includes a 7-day free trial for first-time subscribers, limited to one trial per person. Other plans do not include a trial.
- If you do not cancel, you will be charged £9.99 (or the App Store price on iPhone) when the trial ends, and each month after until you cancel.
- On the web, cancelling during the trial ends it with no charge. Stripe emails you a reminder before the trial ends.
- On iPhone, Apple manages the trial. To avoid being charged, cancel at least 24 hours before it ends.
Cancelling
You can cancel at any time. Cancelling stops future renewals: you keep access until the end of the period you have paid for, and you will not be charged again.
- On the web: in Account, choose Cancel subscription, then confirm. Stripe emails you a confirmation.
- On iPhone: in Account, choose Manage or cancel subscription to open Apple's subscription settings, or go to iPhone Settings, tap your name, then Subscriptions. Your subscription renews unless you turn off automatic renewal at least 24 hours before the end of the current period. Deleting the app or your CMX account does not cancel an Apple subscription.
Changing your mind: your 14-day right to withdraw
Subscriptions bought on the web
If you change your mind within 14 days of your first paid charge, go to Account, choose Withdraw from contract here, then Confirm withdrawal. During a free trial the same button ends the trial with no charge. This is our online withdrawal function. It cancels your subscription and refunds that first payment in full, and you do not need to give a reason. If you started with a free trial, your 14 days run from your first paid charge, not from the start of the trial.
You can also withdraw by emailing hello@cmxai.co.uk with a clear statement, for example using the wording below.
We will refund you without undue delay, and within 14 days of hearing from you, to the payment method you used, at no cost to you. This right applies to the first payment for a subscription, not to later renewals.
Wording you can use
To CMX Ventures Ltd, Parkside, Station Road, St Mabyn, Cornwall, PL30 3BN, hello@cmxai.co.uk:
- I give notice that I withdraw from my contract for the following service: CMX+ or CMX Pro (say which, and whether monthly or annual).
- Ordered on, or first charged on: (date).
- My name and address, and the email address of my CMX account.
- Date.
Subscriptions bought on iPhone
Apple takes payment for iPhone purchases, so refunds are handled by Apple under its policies. You can ask for one in the app using Request a refund, or at reportaproblem.apple.com.
Refunds after 14 days
After the 14-day window, we do not give refunds for part of a billing period. This does not affect your legal rights if the service is faulty or not as described.
Price changes
If the price of your subscription changes, we will tell you at least 30 days before the new price applies, and you can cancel before then. On iPhone, Apple will also tell you under its own rules.
Changes to the service and these terms
We may update CMX+ and CMX Pro, for example to improve lessons or meet legal requirements. If a change significantly reduces what you are paying for, we will tell you in advance and you can cancel. If you do, we will refund anything you have paid for the period after the change.
We will tell you in advance about significant changes to these terms, and if you do not agree, you can cancel before they apply.
Your licence to use CMX
All content and software in CMX+ and CMX Pro belong to CMX or our licensors. While you have an account (and a subscription where needed), you have a personal, non-exclusive, non-transferable licence to use them for your own learning, including for your job. You may not copy, sell, share or republish them, except where the law allows.
Acceptable use
You must not:
- share your account or sign-in details, or resell access;
- copy, scrape or download content in bulk, or use automated tools to access the service;
- use our content to train or improve AI models;
- try to get around our security, the age check, payments or the one-trial limit;
- reverse engineer or interfere with the service, except where the law allows;
- use AI features to create unlawful, harmful or harassing content, or content that infringes anyone's rights, or try to overload or misuse them;
- put a name on a certificate that is not your own name or a name you are known by, or that is offensive;
- break any law.
Your content and certificates
You keep ownership of anything you type into CMX, such as your worksheet or a certificate name, and allow us to use it only to provide the service to you.
A certificate shows that you completed a CMX Pro course. It is not a formal or regulated qualification. Its public verification page shows the name you chose, the course and the date, and you can make it private at any time.
If you believe anything in CMX infringes your copyright or other rights, email hello@cmxai.co.uk with the details and we will look into it.
AI content and no professional advice
- Our lessons are general education about AI, not legal, financial, medical or other professional advice.
- Lessons and illustrations are created with the help of AI tools and reviewed by the CMX team, who are responsible for them. Lesson narration is pre-recorded, AI-generated voice audio.
- AI tutor and sandbox answers (or, in demo mode, sample answers) can be wrong or out of date. Check anything important and do not treat AI output as a final decision.
- You are responsible for how you use AI in your own work, including following your employer's policies and protecting other people's information.
See our AI transparency statement for more.
Availability and support
We work to keep CMX available, but it may sometimes be unavailable, for example during maintenance. For help, email hello@cmxai.co.uk.
Deleting, suspending or closing accounts
You can delete your account at any time: in Account, choose Delete account. This deletes your learning data and cancels a web subscription immediately, so any paid time left ends. If you are still within your 14-day withdrawal period, choose Withdraw and get a refund first. An Apple subscription must be cancelled separately with Apple.
We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or if we learn that you are under 18. Where reasonable, we will tell you first and give you a chance to put things right. If we close your account, or stop providing CMX+ or CMX Pro, for a reason that is not your fault, we will refund anything you have paid for the period after it closes.
Our responsibility to you
- We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that is not foreseeable.
- We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breaking your legal rights as a consumer, including your right to digital content and services that are of satisfactory quality, fit for purpose, as described and provided with reasonable care and skill.
- If defective digital content we supply damages a device or digital content belonging to you, we will repair the damage or pay you compensation. We are not responsible for damage you could have avoided by installing a free update we offered or by following our instructions.
- CMX is provided for personal learning, even when that learning is for your job. We are not liable to you for loss of profit, loss of business, business interruption or loss of business opportunity.
Apple App Store terms
This section applies to the CMX+ iPhone app downloaded from the Apple App Store.
- Agreement with CMX, not Apple: these terms are an agreement between you and CMX Ventures Ltd only, and not with Apple Inc. ("Apple"). CMX, not Apple, is solely responsible for the iPhone app and its content.
- Scope of licence: your licence to use the iPhone app is a non-transferable licence to use it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that it may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing, where available. Where these terms conflict with those Usage Rules, the Usage Rules apply.
- Maintenance and support: CMX is solely responsible for providing maintenance and support for the iPhone app, as set out in these terms or as required by law. Apple has no obligation at all to provide maintenance or support services for the app.
- Warranty: CMX is solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively excluded. If the iPhone app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation in relation to the app, and any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are CMX's sole responsibility.
- Product claims: CMX, not Apple, is responsible for dealing with any claims by you or any third party relating to the iPhone app or your possession or use of it, including product liability claims, claims that the app fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws. These terms do not limit CMX's liability to you beyond what the law permits.
- Intellectual property claims: if a third party claims that the iPhone app, or your possession or use of it, infringes their intellectual property rights, CMX, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.
- Legal compliance: you confirm that you are not located in a country that is subject to a US Government embargo or that has been designated by the US Government as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties. You must not use or export the app in breach of any applicable export control or sanctions laws.
- Developer name and contact: CMX Ventures Ltd, Parkside, Station Road, St Mabyn, Cornwall, PL30 3BN. Phone [PHONE NUMBER]. Email hello@cmxai.co.uk. Please send any questions, complaints or claims about the iPhone app to us.
- Third-party terms: when using the iPhone app, you must comply with any third-party terms that apply to you, such as your mobile network or internet service agreement.
- Third-party beneficiary: you and CMX agree that Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and that once you accept these terms, Apple will have the right (and will be treated as having accepted the right) to enforce them against you as a third-party beneficiary.
Complaints
If something has gone wrong, email hello@cmxai.co.uk and we will try to put it right quickly.
Governing law and courts
These terms are governed by the law of England and Wales, and the courts of England and Wales can deal with any dispute. If you live in Scotland, Northern Ireland or the European Union, you keep the mandatory consumer protections of the law where you live, and you can also bring proceedings in your local courts.
General
- We may transfer these terms to another organisation; we will tell you, and it will not reduce your rights.
- Apart from Apple and its subsidiaries, no one else has any rights under these terms.
- If a court decides that part of these terms is unlawful, the rest stays in force.
- If we delay enforcing these terms, we can still enforce them later.
